Court of Common Pleas of Berks County, Pennsylvania Filing Rules

A motion, application, or praecipe for entry of judgment must be filed with a signed certificate listing each party’s attorney of record and current address, or the name and current address of each unrepresented party.

The non-moving party must respond to the summary-judgment motion within 30 days after service.

For a distribution petition, except in the stated written-agreement and Eminent Domain Code cases, the court enters a decree nisi; absent exceptions, it becomes absolute ten days after service on the other parties and filing due proof of service.

A secure electronic feed in specified unusually complex cases costs $4.00 per page, but the court is not charged for the connection.

The parties may extend dates in the Discovery Management Order by written agreement.

A filing requested to be sealed must be submitted over the counter to the Prothonotary’s Office, not through EFS.

Legal papers filed electronically must be in PDF or another format established for electronic filing; the Prothonotary converts hard-copy or nonconforming submissions to the required format.

Discovery applications and protective orders are not scheduled for regular argument or subject to the B.R.C.P. 211.2 briefing schedule unless the court orders otherwise.

Family Court documents must remain confidential and unavailable for public viewing in CMS unless the court orders otherwise.

The non-moving party may file a written answer to the motion at the same time as its argument brief.
